Drugged Driving: The Traffic Stop

Similar to DUI of alcohol, a drugged driving charge starts with a traffic stop or an accident. From there, the officer gathers information by observations, questions and field sobriety tests. There are specific field sobriety tests for drugs. Not all police officers are trained in them, but officers that are trained are referred to as DRE (Drug Recognition Expert).

If the officer has probable cause to arrest based on the above, then you would be transported to either the station or the hospital and may be asked to submit to a chemical test.

Breath Test and Blood Test for a Rhode Island Drug DUI Charge

If the officer believes you are under the influence of drugs, the officer may conduct a breath test to rule out alcohol or a combination. The officer may also ask if you will submit to a blood test. Blood tests are performed at the hospital by a nurse or doctor. If you agree, blood will be drawn and placed in evidence. The blood will be sent to a lab and tested for alcohol and/or drug levels.

The police will receive the results back and mail you a copy within 30 days. The exact charge would be based on the results and the complaint or charge could be amended to reflect the results.
