Rhode Island Traffic Tribunal / Rhode Island District Court. Lead counsel. Attorney Murphy secured not guilty verdicts on chemical test refusal (R.I.G.L. §31-27-2.1) and speeding following a two-day bench trial before a Traffic Tribunal magistrate. The State's own body camera footage established no indicia of impairment, defeating the required element of reasonable belief of impairment under §31-27-2.1. Attorney Murphy challenged HGN test admission and cross-examined the arresting officer. The concurrent first offense DUI charge (§31-27-2) was subsequently dismissed by the State in District Court. No conviction, no license suspension, no fines, no DUI education requirement.
State v. Winslow (2023)
Rhode Island Superior Court, Judge Kristin E. Rodgers. Lead counsel. Jury acquitted defendant Derek Winslow of murder and firearm charges after a four-day trial. Co-defendants Thomas Mosley (two consecutive life sentences plus 15 years) and Evan Watson (50 years, 20 non-parolable) were already convicted for the same April 13, 2014 murder. Rhode Island Superior Court, Judge Robert D. Krause. Court-appointed counsel (August 2022). Norberto Andrade was convicted in 1987 and sentenced to life plus 25 years for a 1985 rape.
